Effective March, 2008: The Weichert Gold Services Program (“Gold Services”), which includes the Gold Services Performance Guarantee, Weichert Home Connections, Weichert HomeSellerGold Program, and Weichert Home Protection Plan, and which is managed by Mortgage Access Corp. d/b/a Weichert Financial Services (“Weichert”), is available to qualified buyers and sellers and is not conditioned upon doing business, that is, the listing or purchasing of a home, through Weichert, Realtors® or any of its independently owned and operated real estate franchises. Certain terms and conditions apply and Gold Services may not be available in all areas. Conditions for the Gold Guarantee may vary according to state availability of Weichert Gold Partner services. Gold Services Performance Guarantee (“the Gold Guarantee”). The Gold Guarantee requires that a qualified buyer obtain and close the transaction with mortgage financing, homeowner’s insurance, and title insurance through a Weichert Gold Partner. If you qualify, the Gold Guarantee guarantees that the closing date agreed upon by both parties (buyer and seller) in the original contract of sale will not be delayed due to the non-performance of a Weichert Gold Partner, and if the guaranteed closing date is delayed due to the non-performance of a Weichert Gold Partner, you qualify to receive the then applicable Gold Guarantee credit at or after your closing. Your Gold Guarantee is applicable only for that registered transaction and is not transferable or assignable. Certain loan products are not eligible for the Gold Guarantee, such as brokered loan products, VA loans, state loan programs, sub-prime loan products, commercial, and refinance transactions. Only single-family owner-occupied primary and secondary residences qualify for the Gold Guarantee. Other types of property, such as cooperatives, land, condominiums, commercial, mixed use, multi-family (2 or more units), and investment properties are not eligible. The Gold Guarantee is subject to: (1) final loan approval; (2) confirmation of the guaranteed settlement date as appears in the original contract of sale; and (3) receipt by Weichert of: (a) a satisfactory appraisal on the eligible property; (b) a survey; (c) clear and marketable title free of tax and municipal liens; and (d) all required conditions sufficient for final mortgage approval including any secondary financing and mandated declining markets adjustments. Weichert may, at any time and without prior notice, change the terms of the Gold Guarantee, or discontinue the Gold Guarantee qualifications.
You or your attorney or settlement agent must confirm engagement and acceptance with Weichert of the mortgage financing, homeowner’s insurance quote and authorization to commence title searches at least ten (10) business days prior to the original closing/settlement date. Closings of less than twenty (20) business days from receipt of Gold Guarantee application package by Weichert will not be eligible for the Gold Guarantee. The Gold Guarantee does not apply if: (1) you or your attorney or settlement agent decline mortgage financing, homeowners insurance, and title insurance through a Weichert Gold Partner; (2) you do not satisfy all required mortgage conditions including mortgage insurance requirements and confirm acceptance of the property insurance quote and title insurance at least ten (10) calendar days prior to closing; (3) your loan application is denied or cannot be approved by Weichert due to outstanding third party conditions; or (4) you or your attorney or settlement agent change the guaranteed closing date.
Weichert HomeSellerGold Program (“HomeSellerGold”). HomeSellerGold is available to qualified customers. For sellers to be eligible for HomeSellerGold, when you list your house you must meet with a Weichert Gold Services Manager and register in HomeSellerGold. As part of HomeSellerGold, Weichert offers mortgage financing credit approval to any seller for their next purchase. When you list your house and upon your request, Weichert offers credit pre-approval review to your potential buyers. Under HomeSellerGold, we will also guarantee your closing date if a qualified Gold Guarantee buyer (“Gold Buyer”) purchases your house. In the event the closing is delayed due to delivery of the Gold Buyer’s mortgage, title, and/or homeowner’s insurance, then you and the Gold Buyer qualify to receive the applicable guarantee at or after closing.
The terms, conditions, and amount of the guarantee payable for HomeSellerGold and the Gold Guarantee vary by state and product availability. HomeSellerGold and the Gold Guarantees do not apply to closing delays caused by: (1) third party providers, including but not limited to appraisers, surveyors, or municipalities with inordinate recordation delays; (2) extreme conditions, including extreme weather and utility failures, resulting in the closure or disruption of normal service of Weichert and Weichert Gold Partners; (3) state and/or federal decrees or legislation adversely affecting normal commerce including any delays caused by the USA Patriot Act; (4) acts of God; (5) acts of war or terrorism; (6) transportation and postal or other mail carrier services; (7) incorrect wiring instructions for settlement funding; (8) seller’s inability to convey clear and marketable title; (9) seller’s agents; or (10) changes to the closing date in the original contract of sale or other changes to the terms and conditions effecting the closing date and/or related deliverables. In the event Weichert requires only homeowners insurance and/or a complete title search and binder, you agree to provide proof of homeowners insurance and/or a complete title search and binder at least ten (10) business days prior to closing.
All claims for payment of the Gold and HomeSellerGold Guarantee must be made in writing to Weichert within fourteen (14) calendar days of the guaranteed closing date to: Weichert Gold Services, 225 Littleton Road, Morris Plains, NJ 07950 Attn: Gold Services Claims Department. Claims submitted and/or postmarked after fourteen (14) days will not be honored.
Affiliated Weichert companies act as Gold Partners. The list of participating Weichert Gold Partners may change at anytime without prior notice, and some or all of the Weichert Gold Partners may not operate in all states. Please contact one of our Gold Services Managers or call our Weichert Gold Services center directly, 1-800-837-4577, for a list of participating Weichert Gold Partners in your state.
Weichert Home Connections. Weichert reserves the right not to process Connections orders received less than 10 business days prior to the move date. Product and service selection and delivery dates for commencement or installation of the service are at the discretion of the consumer and confirmation by the provider. In processing your order, you acknowledge and understand that you must (1) provide all information required by the service provider and (2)provide any information and/or satisfy any conditions required by local and/or state law. All Home Connections services are provided by independently owned and operated third party vendors. Weichert is not responsible for the performance of, or the acts or omissions, including any delays, attributed to such providers. In no event shall Weichert be responsible to you for any indirect, incidental, special, or consequential damages arising out of the services offered through Weichert Home Connections. Customers are responsible for payment of all charges and monthly invoices contracted for with the provider.
If you elect to purchase a Weichert Home Protection Plan, please refer to your Weichert Home Protection Plan service agreement for complete information on coverage, cost and limitations. Weichert Home Protection Plan coverage is subject to terms, conditions, coverage limits, and a standard deductible per service call per trade agent. Plan coverage varies in every state. Coverage descriptions and claims administration relating to the Weichert Home Protection Plan is provided by independent plan providers.
